Terms & Conditions For Delivery Service
By placing an order with BRISAS TRANSPORT Inc. for pick-up and delivery, you agree to all of the terms and conditions stated herein.
BRISAS TRANSPORT Inc. does not accept shipments that carry a specific time and date of expected delivery unless authorized by management of BRISAS TRANSPORT Inc. Any guarantee, specific or implied is limited to the cost of the delivery.
Actual and Cubic Weights
BRISAS TRANSPORT Inc. reserves the right to re-weigh and re-measure all shipments for the purpose of billing. The higher of the actual or cubic weight will be billed unless a special agreement is in place at the time of shipping.
Dangerous goods will be accepted provided they must meet current transport regulation and are properly contained and identified as dangerous goods.
No claim against fragile shipments will be entertained unless the description on the waybill clearly indicates “FRAGILE.” Shipments containing glass, liquids, ceramic, items requiring temperature control, privately packaged item, or items prohibited unknowingly by BRISAS TRANSPORT Inc., will travel at the shipper’s risk on a no-value basis.
Liability For Loss or Damage
If your shipment is lost or damaged, our liability will be limited to $2.00 per pound, to a maximum value of $5,000, or the actual cost of damages and/or repair, whichever is less.
BRISAS TRANSPORT Inc. shall not be liable for loss, damage or delay related to factors we could not foresee or control, including but not limited to, acts of god, weather conditions, natural disasters, mechanical delays, acts of war, strikes or civil disruption, acts of public enemies or omissions of public authorities.
We will not be liable under any circumstances for any incidental, consequential or special damages to items that are uncrated, improperly packed and labeled, or for concealed damages.
Limits of Liability
A maximum of $5,000 can be declared as value per waybill. Declaired values must authorized by BRISAS TRANSPORT Inc. prior to the movement of the shipment.
Our liability for loss or damage will never be higher than the total declared value (limited to $5,000 per waybill) for the shipment and limited only to those items lost or damaged on a per package basis. Proof of loss or damage is the responsibility of the sender. When you file a claim, it must be made in writing and within 7 days after we deliver your shipment, when the claim results from damage, delay or shortage. If your claim is based on non-delivery, it must be made within 24 hours from the date we took the shipment. All relevant information regarding your claim must be submitted to BRISAS TRANSPORT Inc. within 30 days of its being filed. No claim will be entertained unless you have paid all transportation charges, and the amount of your claim may not be deducted from those charges. If your package is accepted and no indication of damage is made upon the delivery record, we will consider the package delivered in good condition. You must provide us with the original shipping cartons and packaging, if it is available for inspection. Overcharges and refunds must be claimed in writing within 90 days of billing date.
Payment due on receipt of Invoice. 2% per month (24% per year) service charge will be applied on balances exceeding 30 days.
